FAIR Act

No report required. Under Section 4(b)(5) of the FAIR Act, as added by P.L. 109-115, any agency “with fewer than 100 full-time employees as of the first day of the fiscal year” is exempt from submitting an inventory for that year of non-inherently governmental (i.e., commercial) activities performed by federal government sources. Also, the Office of Management and Budget (OMB) exempts these agencies from submitting an inventory of inherently governmental activities.
